Terms and conditions
§ 1 Scope and provider
These Terms and Conditions (T&Cs) apply to all orders placed by consumers and businesses through the surrealm.de shop with Neuronetz UG (haftungsbeschränkt), Ottostraße 38, 85521 Ottobrunn, Germany (hereinafter “we” or “the provider”). A consumer is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business or profession (§ 13 German Civil Code). Deviating terms of the customer do not become part of the contract unless we expressly agree to their validity.
§ 2 Subject matter
We offer the handmade collectible box “Darvin Stonebraid”, limited to 100 pieces. The box contains an unpainted resin miniature (approx. 10 cm), twelve Jacquard Airbrush Colors (118 ml each), a printed painting guide, a character card and a certificate of authenticity. An optional edition additionally includes a Gaahleri Mobius airbrush tool. The miniature is expressly delivered unpainted; painting is the customer's responsibility. Images of painted figures are illustrative examples.
§ 3 Conclusion of contract (order and payment)
The presentation of the products in the shop does not constitute a legally binding offer but an invitation to order. By submitting your order via the “Order with obligation to pay” button, you make a binding offer to conclude a purchase contract.
After receiving your order, we send you an acknowledgement of receipt by e-mail. If you pay by advance bank transfer, it contains the bank details for the transfer; if you pay by credit card, the amount is charged immediately via the payment page hosted by Stripe. This acknowledgement does not yet constitute acceptance of your offer. The purchase contract is concluded when we accept your order — at the latest when production begins after receipt of payment.
If you pay by advance bank transfer, the goods must be paid in full in advance within 7 days of receiving the bank details. If payment is not received in time, the reservation lapses automatically and the reserved pieces are released again; no contract is concluded in that case. If you pay by credit card, the amount is charged immediately during the order process. In both cases, production begins only after receipt of full payment.
§ 4 Prices and shipping costs
All prices stated are in euros and include statutory German value-added tax (VAT), plus shipping costs. Shipping costs are computed on the server based on the delivery country and shown to you before you complete the order.
§ 5 Payment
Payment can be made either by advance bank transfer (SEPA / Vorkasse) or by credit card (via Stripe).
If you pay by advance bank transfer, you receive the bank details by e-mail after ordering. Please state the order number as the payment reference. Receipt of the full amount in our account is decisive for meeting the deadline; you do not have to wait for the bank details, as they are sent immediately after your order.
If you pay by credit card, the payment is processed via a payment page hosted by Stripe and the amount is charged immediately; there is no waiting time for bank details.
§ 6 Delivery, made-to-order production and delivery times
Each box is made to order (print-on-demand): printing begins only after receipt of your payment. You are informed about the production stages (in the queue, in production, finishing and quality check, dispatched).
Information on delivery times are estimates resulting from the current queue and our production capacity; they are not firmly promised delivery dates. A distinction must be made between the estimated dispatch time (handover to the carrier) and the subsequent transit time of the shipping service provider until delivery. A binding delivery date is owed only upon express separate agreement.
This is an edition limited to 100 pieces. Once the edition is exhausted, delivery is no longer possible.
§ 7 Retention of title
The delivered goods remain our property until full payment. As the purchase price is payable in full before production both for advance bank transfer and for credit card payment, delivery regularly takes place only after full payment has been received.
§ 8 Warranty / liability for defects
The statutory rights regarding defects apply. With handmade products, minor deviations in surface, colour and dimensions may occur due to manufacturing and material; these do not constitute a defect insofar as they correspond to the nature of a handmade individual piece and do not impair usability. The figure is delivered unpainted; the painting result is the customer's responsibility and is not subject to the liability for defects.
§ 9 Liability
For damage arising from injury to life, body or health, and for damage from the breach of essential contractual obligations (cardinal obligations), we are liable in accordance with the statutory provisions; likewise in cases of intent and gross negligence. In the case of slightly negligent breach of an essential contractual obligation, our liability is limited to the foreseeable damage typical for the contract. Otherwise liability is excluded. Liability under the Product Liability Act remains unaffected.
§ 10 Dispute resolution
The European Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr. Regarding our willingness or obligation to participate in dispute resolution proceedings before a consumer arbitration board, see the information in the legal notice.
§ 11 Right of withdrawal
Consumers have a statutory right of withdrawal. The details are set out in our right-of-withdrawal policy.
§ 12 Final provisions
The law of the Federal Republic of Germany applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection provisions of the state in which the consumer has their habitual residence remain unaffected. Should individual provisions of these T&Cs be or become invalid, the validity of the remaining provisions remains unaffected.
